Both the man and woman who are inland residents and planning to apply for divorce voluntarily shall go and complete the formalities at the marriage registration authority that has jurisdiction over the place where the permanent household of one of them is registered.
内地男女居民自愿申请离婚的，应当到此中一方常住户所在地有管辖权的婚姻注销机关打点离婚手续。
As for Chinese citizens who are planning to apply for divorce voluntarily from foreigners on the Chinese mainland and Chinese inland residents who are planning to apply for divorce voluntarily from Hong Kong, Macao residents or overseas Chinese on the Chinese mainland, both the man and woman shall go and complete the formalities at the marriage registration authority that has jurisdiction over the place where the permanent household of the Chinese inland resident is registered.
中国公民自愿向在中国大陆的外国人申请离婚，中国内地居民自愿向在中国大陆的香港、澳门或者华侨申请离婚，男女两边应当到中国内地居民常住户所在地有管辖权的婚姻注销机关打点离婚手续。

离婚注销所需的文件及证明书
1. A Chinese inland resident seeking divorce shall produce the following certificates and documents:
1. 中国内地居民申请离婚，应当出示下列证明文件:
(1) His/her household register and ID card;
(1)其户籍及身份证;
(2) His/her marriage certificate;
(2)其成婚证明书;
(3) Divorce agreement signed by both parties.
(3)两边签订的离婚协议书。
2. Hong Kong or Macao residents, overseas Chinese and foreigners applying for divorce shall produce the following certificates and documents:
2.香港或澳门居民、海外华人及外国人申请离婚，须出示下列证明文件:
(1) His/her marriage certificate;
(1)其成婚证明书;
(2) Divorce agreement signed by both parties.
(2)两边签订的离婚协议书。
Apart from the certificates and documents specified above, Hong Kong or Macao residents applying for divorce shall also produce his/her valid exit-entry permit and ID card, while the overseas Chinese or foreigners seeking divorce shall also produce his/her valid passport or other valid international travel documents.
香港或澳门居民申请离婚，除上述证明文件外，还须出示有效的出进境答应证和身份证，海外华人或外国人申请离婚，也须出示有效的护照或其他有效的国际游览证件。
Divorce agreement shall record both parties’ intention of voluntary divorce and consensus on issues of bringing-up children, property and liability.
离婚协议书应当载明两边自愿离婚的意向，以及在抚育子女、财富和责任等问题上的共识。
